The officer involved in a deadly Greece shooting has not been indicted by a Monroe County grand jury.
The grand jury determined that Officer Jeffrey Fraser's actions were justified.
Just after 2 a.m. on April 5, Fraser responded to a 911 call on Betwood Lane after a man called to say that he was going to kill his wife. When Fraser arrived, Greece Police Chief Patrick Phelan said 81-year-old Robert Litolff pointed a Marlin 22 rifle at the officer.
Fraser shot Litolff, as per protocol, when he refused to drop the rifle. Fraser fired his weapon 17 times, hitting Litolff once in the chest and once in the foot. Litolff died from his injuries.
Litolff’s wife was sleeping at the time of the shooting, and was not hurt.
Fraser, a two-year-veteran of the force, was also not hurt. His wife was riding with him in the car for a department-approved ride along at the time of the shooting.
Investigators don’t know why Litolff pointed the rifle at police officers, and they may never know his motive for the crime.
